School district investigation reveals more noncompliance

During the site visit, state officials examined 50 IEPsA in addition to those that triggered the visitA and found 68 additional legal citations, the report says.

Concerns included the following:A changes made to IEPs through emails rather than by reconvening students’ IEP teams; reports by interviewees suggesting some programming placement decisions forA students with disabilitiesA are predetermined; a lack of timely notice to parents about IEP meetings; a lack of available services to create goals for some students and a practice of requiring some students to earn participation in extracurricular activities, according to the report.

The report saidA the district’s strengths include staff commitmentA to serving diverse students, interest in partnering with the Grant WoodA Area Education Agency, and concern among school board members for families and students.

But it also raises concerns about interviewees referring to the requiredA corrective actionA as merely a adocumentation issue” and says the compliance issues are A more substantial.

“Failure to invite parents in a timely manner, failure to notify parents of changes in services, failure to fully describe the support services that are to be provided and failure to adequately describe why a student needs separate services all have potential impact on the delivery of a free appropriate public education,” the report says.

State officials recommended that the district clarify the distinction between “procedural and substantive noncompliance with IDEA.”

Murley said district officials plan to work with state and Grant Wood Area Education Agency officials on offering this clarification.

The Department of Education will follow up in NovemberA and June 2017 to check on the district’s progress on completing the required corrective actions.
